A LUTTERWORTH takeaway boss who was found dead in his flat in January this year was in high spirits and a ‘very happy’ mood just hours before his death, a court was told.
Dogan Dogan died in his bedsit flat above Aladdin’s takeaway in Linton Street Leicester in the early hours of Sunday, January 8.
He had been tied up and gagged with layers of cloth, causing him to suffocate.
At Birmingham Crown Court on Thursday Johnny Booker, who was the manager of Pizzaman in Church Street, Lutterworth, said he spent the evening working with Mr Dogan before Mr Dogan left in the early hours to go back to his Leicester flat.
Mr Booker said Mr Dogan had been very happy and was a hard working nice guy, he added.
The court was also shown CCTV footage of Mr Dogan leaving Pizzaman and travelling back through Leicester to Aladdin’s.
About an hour later a VW Passat which the prosecution say was carrying the three defendants - Wali Khan (32), Naveed Naveed (28) and Sarwar Gader (35) - was shown on CCTV driving away from Linton Street through Leicester towards the M1.
At one point a private CCTV camera on the Leicester ringroad caught items being thrown from the vehicle.
These were later recovered and found to belong to Mr Dogan.
The three defendants travelled to Luton where they spent a few hours before once again being caught on CCTV buying food at a takeaway at Leicester.
The defendants never offered any explanation as to why they had gone to Luton, only to come back 12 hours later, the court heard.
Dr Stuart Hamilton, a forensic pathologist, also gave evidence.
He told the court that Mr Diogan had suffered a number of injuries during an attack, including three broken ribs which he said looked as if they had been inflicted by kicking.
He also said Mr Dogan had been heavily gagged with several layers of cloth.
He added: “He would have been unconcious within a small number of minutes.”
A neuro-surgeon who examined Mr Dogan’s brain said he would have died within about 35 minutes of being gagged.
Statements from several people were also read out in court, each saying what a nice guy Mr Dogan was and how he had no enemies.
